SUMMARY OF TERMS AND ACCOUNT CHARGES:
• As a recurring dues member, you are agreeing to pay for your membership on a recurring dues basis, subject to the terms of this agreement.
• This agreement is for the recurring dues term and will automatically renew and continue on a month-to-month basis, provided that you may cancel after your initial recurring dues term by providing us with no less than thirty (30) days advance written notice.
• This agreement is to inform you, the client, that the price per membership is not guaranteed to stay the same and is subject to change.
• This agreement informs you, the client, that your purchase of membership or class card passes are non-transferable, and non-refundable.
• Your recurring dues billing will begin on the day of purchase and will continue on the same day each month thereafter until you cancel.

MEMBERSHIP AND PACKAGE TYPES AND APPLICABLE GUIDELINES
• 10 Class Pass – Three-month expiry. Not shareable. Not auto renewing.
• 20 Class Pass – Six-month expiry. Shareable between 2 people max. Not auto renewing.
• 50 Class Pass – Twelve-month expiry. Shareable between 4 people max. Not auto renewing.
• One month unlimited. No contract. Auto renewing on scheduled date once monthly. 2 weeks notice to cancel.
• Month to Month. One-year contract. Auto renewing on scheduled date once monthly. Minimum 3 month commitment. 30 days notice to cancel with termination fee.
• One year unlimited. One full payment. No contract. Not auto renewing.
• Mat & Towel service. One-month expiry. Option for auto renewing and non-renewing.

LATE CANCEL AND NO-SHOW FEES.
All members will be charged a $10 CAD “Late Cancellation” fee if a The Yoga Bar class is booked and student failed to cancel the scheduled class within at least eight (6) hours before the start of the class. A $10 CAD “No-Show Fee” will apply if any student who reserves a class and fails to show for the class before the start time of the class.

CONSENT TO AUTO-RENEWAL (All references to “I”, “me”, or “my” in this section shall refer to you)

MONTH-TO-MONTH: I understand that my membership will be on a month-to-month basis and will automatically renew monthly, provided that I may terminate this agreement at any time by providing not less than thirty (30) days advance written notice either by email to The Yoga Bar, and to the extent permitted by applicable law, I will be expected to pay any remaining dues, fees and charges associated with my account.
Memberships can be put on hold for a minimum of 30 days with the maximum period of 2 months (60 days) The Yoga Bar requires 20 days notice in advance to the start date of the hold.

PAYMENT AUTHORIZATION
By signing below, I am authorizing The Yoga Bar, to debit my designated bank account described above for purposes of paying, on a recurring basis, all or a portion of the dues, fees, and charges which I owe under this agreement, including my monthly membership dues, and applicable taxes. This is an authorization for personal pre-authorized debits. Such dues, and charges will be debited from my designated bank account on the dates set forth in the payment schedule under this agreement. The Yoga Bar will obtain my authorization for any one time or scheduled debits. I acknowledge that I may cancel this authorization by providing The Yoga Bar with at least thirty (30) days written notice prior to the next scheduled debit from my bank account. I understand that I have certain recourse rights if any debit does not comply with this agreement. For example, I have the right to receive reimbursement for any debit that is not authorized or is inconsistent with this pre-authorized debit agreement. I agree that I must provide The Yoga Bar with prior notice of any changes to my account information.
Should you default on any payment obligation as called for in this agreement, The Yoga Bar, will have the right to declare the entire remaining balance due and payable, and all costs of collection, including but not limited to collection agency fees and legal fees. A default occurs when any payment due under this agreement is past due for more than ninety (90) days.
A SERVICE FEE WILL BE CHARGED IMMEDIATELY FOR ANY CHEQUE, DRAFT, CREDIT CARD, OR ORDER RETURNED FOR INSUFFICIENT FUNDS, OR ANY OTHER REASON. SHOULD ANY MONTHLY PAYMENT BECOME MORE THAN FIVE (5) DAYS PAST DUE, YOU WILL BE CHARGED A LATE FEE. This provision is subject to any applicable provincial, territorial, or federal laws.

CONSUMERS RIGHTS TO CANCEL
This is a contract to which the Business Practices and Consumer Protection Act applies.
Under no circumstances shall the term of this agreement exceed one year.
You may cancel this contract from the day you enter the contract until ten (10) days from the date of receipt of this contract. You do not need a reason to cancel. To cancel, you must give notice of cancellation at the address in this contract. You must give notice of cancellation by a method that will allow you to prove that you gave written notice via email. If you send the notice of cancellation by email, it doesn’t matter if The Yoga Bar receives the notice within the required period as long as you sent it within the required period.

MEMBERSHIP. If you are a month-to-month member, you may terminate this agreement after the minimum commitment of 3 months is met, by providing The Yoga Bar with a written 30-day notice via email. Members are required to pay a one time early termination fee of $150.00. Memberships will be terminated 30 days upon written cancellation notice. Whether you are a month-to-month or fixed term member, once The Yoga Bar receives your written notice of cancellation, your membership will remain active until the expiration of your then-current billing cycle. Classes not used by the expiration of your then-current billing cycle after sending in your notice of cancellation will be forfeited and lost, and no refund will be issued.

REFUNDS. The Yoga Bar will not issue refunds after the 10 day cool off period.

REFUNDS DUE TO MEDICAL. Refunds due to injury, illness, or physical limitations will be authorized on a case by case basis. We require a Doctor’s note or medical proof for approval.

REFUNDS DUE TO RELOCATING. Refunds due to moving will be authorized on a case by case basis for anyone moving outside of a 15km radius of any of The Yoga Bar locations. 30 days written cancellation will still apply. We require two approved proofs of move as follows; home utilities bill, landline or internet bill, change of address on government approved id, changed registration on car insurance, school acceptance letter, and job acceptance letter.

OTHER TERMS AND CONDITIONS

VIDEO AND MEDIA RELEASE. The Yoga Bar reserves the right to display, publish, produce, and distribute any media filmed/recorded in the studio. We reserve our right to use video/audio and other media for use on the internet and social media marketing. This is understood to come with no compensation to you, the client, at any time.

LIMITED LIABILITY. Unless prohibited by applicable law, any award by a court or arbitrator is limited to actual compensatory damages. Neither a court nor an arbitrator can award either party any indirect, special, incidental or consequential damages, even if one party told the other party that they might suffer these damages.

NON-DISCRIMINATION. The Yoga Bar represents that it will not discriminate against any person because of sex, race, creed, age, color, origin, sexual orientation, or personal medical decisions in considering applications for memberships.

MEMBERSHIP TERMINATION. We reserve the right to terminate your membership for any reason not expressly prohibited by law. In the event of termination, we will notify you in person or send you a written notice of termination to your email or home address on file.

ENTIRE AGREEMENT. Verbal agreements with a The Yoga Bar employee will not be accepted as valid. Only this agreement, and all rules and regulations of The Yoga Bar, as revised from time to time, constitute the entire and exclusive agreement between you and The Yoga Bar, and supersede all prior written and/or oral promises, representations, understandings and/or agreements relating to this membership purchase.

GOVERNING LAW. This agreement shall be governed by the laws of the province or territory where you reside and the federal laws of Canada applicable therein. The parties irrevocably attorn to the jurisdiction of the courts of the province or territory where you reside.

INVALID PROVISIONS. If any part of this agreement is found to be invalid or unenforceable, the remainder of the agreement will be valid and enforceable.
